SPAIN IS THE FIRST EUROPEAN NATION TO PASS THE LAW OF “ PAID MENSTRUAL LEAVE POLICY ” on FEBRUARY 16,2023 . IN SPAIN, LAW GIVES THE RIGHT TO A WOMAN TO TAKE 3 DAYS MENSTRUAL LEAVE. IT MAY BE POSSIBLE TO EXTENT IT TO 5 DAYS IN CASE OF DISABLING PERIODS, WHICH CAN CAUSE SEVERE CRAMPS, DIZZINESS AND EVEN VOMITING.THE LEAVE REQUIRES A DOCTOR'S NOTICE.

WHAT IS MENSTRUAL LEAVE?

MENSTRUAL LEAVE IS A TYPE OF LEAVE WHERE A FEMALE HAVE THE OPTION TO TAKE PAID OR UNPAID LEAVE  FROM THEIR EMPLOYMENT IF THEY ARE MENSTRUATING AND UNABLE TO GO FOR WORK IN ITS MENSTRUAL CYCLE.

 

PERIODS CAN BE A PROBLEM

FOR SOME WOMEN'S PERIODS CAN BE A PROBLEM .MOST OF THE WOMEN'S HAVE IRREGULAR PERIODS. USUALLY, PERIODS OCCURS AFTER ONE MONTH IN NORMAL MENSTRUAL CYCLE. IRREGULAR PERIODS CAUSE DUE TO HORMONAL IMBALANCE, STRESS, HEALTH CONDITIONS, MEDICATION, ETC

 

CONDITIONS RELATED TO IRREGULAR MENSTRUATION 

THERE ARE FOUR CONDITIONS RELATED TO IRREGULAR MENSTRUATION.

1) AMENORRHEA: A condition where your periods have stopped completely. The absence of a period for 90 days or more is considered abnormal unless you’re pregnant, breastfeeding or going through menopause (which generally occurs between ages 45 and 55). If you haven’t started menstruating by age 15 or 16 or within three years of your breasts developing, you may also have amenorrhea.

 

2)OLIGOMENORRHEA: A condition where your periods occur infrequently. You may go more than 35 days between periods or have six to eight periods a year.

 

3)DYSMENORRHEA: A medical term for painful periods and severe menstrual cramps.

 

4)ABNORMAL UTERINE BLEEDING: Abnormal uterine bleeding is bleeding between monthly periods, prolonged bleeding or an extremely heavy period.


IN INDIA EXCEPT BIHAR AND KERALA , DON'T HAVE ANY LAW REGARDING MENSTRUAL LEAVE BUT RECENTLY SHAILENDRA MANI TRIPATHI FILES THE PLEA AGAINST FRAME REGULATIONS OF MENSTRUAL LEAVE. ADVOCATE VISHAL TIWARI IS THE REPRESENTATIVE OF THIS PLEA.

 

BUT THE SUPREME COURT REFUSED TO  ENTERTAIN A PIL (PUBLIC INTEREST LITIGATION) OF MENSTRUAL PAID LEAVE FOR FEMALE STUDENTS AND WORKING WOMENS. A BENCH HEADED BY CHIEF JUSTICE DY CHANDRACHUD SAID, "THE PLEA HAS BEEN FILED UNDER SECTION 32 AND SEEKS LEAVE FOR MENSTRUAL PAIN FOR STUDENTS AND WOMEN EMPLOYEES. HAVING REGARD TO THE POLICY, THE PETITIONER TO APPROACH THE UNION MINISTRY OF WOMEN AND CHILD DEVELOPMENT MINISTRY TO FRAME A POLICY. 

 

HOWEVER, THERE ARE A MANY WOMEN'S HAVE ARGUED AGAINST THE PERIOD LEAVE BECAUSE ACCORDING TO THEM IT REDUCES ITS EQUALITY AND CREATE HINDRANCES IN PROMOTIONS. IT CREATES THE GENDER DIFFERENTIATION.

WORLDWIDE, THERE ARE SMALL NUMBER OF COUNTRIES THAT OFFERED MENSTRUAL LEAVE INCLUDING JAPAN,TAIWAN, INDONESIA, VIETNAM, OR ZAMBIA.

 

ON 16 FEBRUARY 2023, SPAIN BECAME THE FIRST EUROPEAN COUNTRY TO PROVIDE PAID MENSTRUAL LEAVE.THE WOMEN THERE CAN NOW HAVE RIGHT TO TAKE THREE DAYS MENSTRUAL LEAVE AND EXTEND IT TO FIVE DAYS IN CASE OF PAINFUL PERIODS.

BUT ACCORDING TO THE PIONEER, IN 2016 SWEDEN WAS THE WORLD'S FIRST COUNTRY TO INTRODUCE A PAID MENSTRUAL LEAVE.

 

AFTER THIS, IN 2015 ZAMBIA INTRODUCED MENSTRUAL LEAVE POLICY FOR WOMEN WHERE WOMEN TAKE ONLY ONE DAY LEAVE IN A MONTH.

 

APART FROM THIS, IN 2017, ITALY BECAME FIRST EUROPEAN COUNTRY INTRODUCES THREE DAYS MENSTRUAL LEAVE BUT IT WASN’T PAID LEAVE POLICY. IN 2019, PHILIPPIANS ALSO PASSED A LAW OF MENSTRUAL LEAVE FOR FEMALE WORKERS.HERE, LEAVE TAKE UP ONLY FOR TWO DAYS A MONTH. 

 

PERSONAL OPINION

PERSONALLY, I FEEL THAT MENSTRUAL LEAVE IS NOT A GOOD OPTION . A WOMEN DIDN’T FEEL COMFORT IF EVERYONE IS TREATED HER LIKE A SICK PEOPLE AND BECAUSE OF THIS A WOMEN IS APATHETIC.

 

IF WOMEN GETS A MENSTRUAL LEAVE THAN COMPANIES DON'T GIVE THE EQUAL OPPORTUNITIES TO THE WOMEN’S AND EVEN DON'T GET SENIOR LEVEL POSITIONS IN THE COMPANIES.
